Terms & Conditions (of Sale)

These Terms & Conditions (“Terms”) govern purchases made from Benson & Clegg (“we”, “us”, “our”) via our website. Please read them carefully before ordering. They do not affect your statutory rights.

2. Ordering & contract formation

  • Your order is an offer to buy the products listed in your basket.

  • We’ll email an order acknowledgement after checkout. A contract is formed only when we email a dispatch confirmation or otherwise ship your order.

  • If we’re unable to accept your order (e.g., stock, pricing or payment issues), we’ll notify you and issue a refund where applicable.

3. Prices, taxes & payment

  • For customers based in the UK, prices are shown in GBP and include UK VAT where applicable.

  • For customer based outside of the UK, prices are shown in your local currency and do not include UK VAT.

  • We accept the payment methods shown at checkout. Payment is taken when you place your order.

  • We try to ensure prices and descriptions are accurate. If we discover an error, we may cancel the order and refund you in full before dispatch.

4. Delivery

  • We deliver using the services offered at checkout. Delivery dates are estimates only; we’ll deliver without undue delay and within 30 days unless we agree otherwise.

  • Risk in the goods passes to you on delivery to the address you provide. Please check parcels on arrival and tell us promptly about any issues.

5. International delivery & customs

  • Orders shipped outside the UK may be subject to import duties, taxes and carrier handling fees levied by the destination country. These are the customer’s responsibility and are not included at checkout unless expressly stated.

  • The carrier or local customs may contact you to arrange payment. Shipments can be delayed by customs processes, which are outside our control.

6. Right to cancel (change of mind)

If you are a consumer (not buying in the course of business), you have a legal right to cancel most online purchases.

  • Cancellation period: You may cancel your order within 14 days from the day after you (or a person you nominate) receives the goods.

  • How to cancel: Email enquiries@bensonandclegg.com with your order number and a clear statement that you wish to cancel. Please note that sometimes cancelation may not be possible if your order has been processed and dispatched before we can process your e-mail. 

  • Returning the goods: After notifying us, you must send the goods back within 14 days. We recommend a tracked service. You are responsible for return costs unless the goods are faulty or not as described.

  • Condition: You may inspect the goods as you would in a shop, but you’re liable for any diminished valueresulting from unnecessary handling.

  • Refunds: We will refund the product price and the cost of our standard outbound delivery (if paid), within 14 days of receiving the goods back or of receiving evidence you have sent them back—whichever is earlier. If you chose an enhanced/express delivery, we will not refund the supplementary cost. Refunds are made to the original payment method.

Your 14-day cancellation right does not apply to:

  • Personalised, engraved, or made-to-order items.

  • Any other items that are excluded under consumer law.

  • This does not affect your rights where items are faulty or misdescribed.

7. Faulty or misdescribed goods (your statutory rights)

If a product is faulty or not as described, you have rights under the Consumer Rights Act 2015:

  • Within 30 days of delivery: you may reject the goods and get a full refund.

  • After 30 days and within 6 months: we’re entitled to offer a repair or replacement first. If that’s impossible or fails, you may be entitled to a refund (in some cases with a deduction for use).

  • These rights apply in addition to any manufacturer’s warranty. Please contact us at [insert email] with your order number and details/photos of the issue.

8. Returns process (all returns)

  1. Contact us at enquiries@bensonandclegg.com for return instructions.

  2. Pack items securely (including any branded boxes/pouches) and obtain proof of postage.

  3. Once received and inspected, we’ll process your refund or exchange as applicable. We reserve the right to refuse returns that are sent back outside the stated timescales or not in reasonable condition (except where you are exercising statutory rights).

9. Product information

Our products are crafted with care. For finishes such as polishing, burnishing, or natural stone, subtle variations in tone are a feature of the design. Colours may vary slightly by device display. This section does not limit your statutory rights if a product is misdescribed.

10. Promotions & gift messaging

From time to time we may run promotions. Unless stated otherwise, promotional codes cannot be combined and do not apply to gift cards, bespoke orders, or shipping. If you return items purchased with a promotion, your refund will reflect any promotional savings.

11. Liability

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any matter for which liability cannot legally be limited. We are not liable for losses that were not foreseeable to both parties when the contract was formed, or for business losses (including loss of profit, revenue or goodwill).

12. Intellectual property

All content on our website (including imagery, copy and brand marks) is owned by or licensed to Benson & Clegg and is protected by intellectual property laws. You may not use it without our prior written consent.

13. Governing law

These Terms are governed by the laws of England and Wales. The courts of England and Wales will have exclusive jurisdiction, but consumers resident elsewhere may also bring claims in their local courts as allowed by local law.
